Terms of service

This is a courtesy translation. The service operates under the law of the Russian Federation, and the Russian edition of these terms is the one with legal force. Where the two texts differ, the Russian text applies.

Русаков Алексей Александрович, a sole proprietor registered in Russia (hereinafter the Provider), invites any legally capable individual (hereinafter the Customer) to enter into an agreement for creating a video from a photograph on the terms set out below.

Paying for an order means full and unconditional acceptance of these terms. Questions about the terms can be sent before payment to hello@ozhivi.pro.

1. What we do

The Provider takes a photograph uploaded by the Customer and, using neural network services, creates a short video in which the people and objects in the picture begin to move.

The service works in one of two modes, chosen by the Customer:

• Animate. Movement is returned to what is already in the frame. The person turns their head slightly or moves their shoulders and smiles softly, and the camera sways slightly, as if handheld. The Customer gives no instructions in words. Up to 5 photographs can be attached to one order. Each is processed separately, and they are paid for as one sum.
• Your scenario. The Customer describes in words what should happen in the frame, and that description becomes part of the task given to the neural network that creates the video. This mode uses models that perform the stated action. Its prices are listed in section 2.

The Customer chooses the duration. The lower bound depends on the chosen quality and is shown on the order page. The upper bound is 10 seconds.

The service is considered rendered at the moment the finished file becomes available for download on the order page.

2. Price and payment

The price is charged per second of finished video and depends on the chosen quality. The set of qualities differs between the modes.

Animate mode:

• Basic: 20 ₽ per second, from 3 to 10 seconds
• Premium: 30 ₽ per second, from 3 to 10 seconds
• Maximum: 100 ₽ per second, from 4 to 10 seconds

Your scenario mode:

• Simple: 30 ₽ per second, from 3 to 10 seconds
• Precise: 70 ₽ per second, from 4 to 10 seconds
• Maximum: 100 ₽ per second, from 4 to 10 seconds

With several photographs the total is the sum of their individual prices.

The total is shown before payment and is frozen at the moment the order is created. Payment is made in advance through the YooKassa payment service, in Russian rubles. The Provider applies the professional income tax regime. The receipt is issued through the “My Tax” service of the Russian Federal Tax Service.

3. Timing

The usual production time is 3–6 minutes per photograph from the moment payment arrives. Photographs in one order are processed in sequence, each taking 3–6 minutes. Under heavy load the time may increase, but not beyond 24 hours for the whole order.

If the Provider fails to deliver within 24 hours, the money is refunded in full and automatically, with no claim required from the Customer.

The finished file is stored for 30 days from the moment it is ready, after which it is deleted beyond recovery. Download it in time.

4. What is guaranteed and what is not

The Provider guarantees that the video will be created from the submitted frame, will be of the stated duration and will become available for download.

The Provider does not guarantee the specific content of the movement, that the result will match the Customer’s expectations, or its artistic quality. The result is produced by a neural network and is not fully predictable.

The Customer understands that the source photograph affects the result: on a small, blurred or badly damaged image the movement comes out worse. The service warns about such images before payment.

5. Refunds

The money is refunded in full and automatically if:

• the video could not be created for technical reasons after three attempts
• the photograph failed the check after payment had been made
• production took longer than 24 hours

In an order of several photographs the refund is calculated for each of them separately: if two out of five did not work out, the cost of those two is returned and the three finished videos remain with the Customer.

The refund goes back by the same method the order was paid with, without any application from the Customer. Crediting takes between one and ten business days depending on the bank.

If the video has been created and is available for download, the service is considered rendered and the amount paid is not refundable, including when the result did not match expectations. Before production begins the Customer may withdraw from the service by writing to hello@ozhivi.pro.

6. Rights to the photograph

By uploading an image, the Customer confirms that:

• they are entitled to use this photograph and to submit it for processing
• they have the consent of the people depicted, or are their close relative, or the people depicted have died and they act with the consent of other close relatives
• the image infringes no third-party rights and contains no prohibited content

Exclusive rights to the created video belong to the Customer. The Provider does not publish customers’ work and does not use it in advertising without separate written permission.

The Provider may refuse to process an image containing nudity or sexual scenes, images of minors unclothed or in underwear or swimwear, scenes of violence or the use of weapons, depictions of the deceased in a distressing manner, or documents with other people’s data. In such a case the money is refunded in full.

7. Liability

The Provider’s liability is limited to the amount paid for the order. The Provider is not liable for interruptions caused by failures of third-party services, communication providers and hosting, nor for the result being unavailable after the storage period has ended.

8. Personal data

The processing of personal data is described in the privacy policy. The Customer gives consent to the processing, including the transfer of data outside the Russian Federation, separately, by ticking the box on the order form before uploading a photograph. 9. Changes

The Provider may change these terms by publishing a new edition on this page. Orders already paid for are governed by the edition in force at the moment of payment.
